As per the Right to Education Act (RTE), 2009, a school -

Section 12.(1) (b) Specified in sub-clause (ii) of clause (n) of section 2 shall provide free and compulsory elementary education to such proportion of children admitted therein as its annual recurring aid or grants so received bears to its annual recurring expenses, subject to a minimum of twenty-five per cent;

Section 12.(1) (c) Specified in sub-clauses (iii) and (iv) of clause (n) of section 2 shall admit in class I, to the extent of at least twenty-five percent of the strength of that class, children belonging to weaker section and disadvantaged group in the neighbourhood and provide free and compulsory elementary education till its completion: Provided further that where a school specified in clause (n) of section 2 imparts pre-school education, the provisions of clauses (a) to (c) shall apply for admission to such pre-school education."

1. With respect to the grievances/complaints related to Section 12(1)(c) of the RTE Act, 2009, provide details of grievances/complaints that have been registered, or received, or taken-up, or acted upon by the commission either online, or offline, or in-person, or suo-moto, or through other means; Provide year-wise information sought as below:

a. The total number of grievances registered, or received, or taken-up by the commission for the past 5 years.

b. Mention the sources through which the grievances are received by the commission (Example: online, in-person, Suo-moto, received from any department or official, etc)

c. Provide the number of grievances/complaints resolved. Please provide data for the past 5 years.

d. Provide the number of filed grievances that are pending. Please provide data of the past 5 years.

e. Mention the number of grievances pending at each of these levels – State Education department, District Education Office, Block Education Office, and School.

f. Mention the top 5 most stated reasons by designated officers for pending grievances.

g. Provide the minutes of the meetings, file documents, letters, etc related to the redressal of grievances by the commission.

h. Details of the punitive action initiated against schools who have not registered for the 12.1.c process from 2013-14 to 2018-19.

i. Details of the measures taken against schools that have denied admissions under the 12 (1)(c) provision from 2013-14 to 2018-19.

j. Provide copies of show-cause notices issued by the commission in a matter related to the implementation of section 12.1.c RTE Act to any of the Education Department officials or private schools in the light of filed grievances.

2. Provide copies of files, documents, etc of the funds allocated to the SCPCR. Please provide data for the past 5 years, along with any copies thereof.

a. How much of the allocated fund has been utilized by the SCPCR? Please provide data of past 5 years.

b. Mention the major heads under which funds have been utilized. Please provide data for the last 5 years.

c. Provide the details of members, including the commissioner, and office staff currently engaged with the SCPCR.

d. Please provide details of category wise - posts sanctioned, posts filled, and posts vacant.

e. Provide the details of such members or office personnel mapped to RTE-section of SCPCR, if any.

f. Provide annual reports of the last 5 years prepared by SCPCR

g. Mention if any of the commission’s report has ever been placed in the assembly. Provide copies of such reports.

Provide hard copies, electronic copies where available in a CD/DVD, of relevant records, documents, memos, emails, opinions, advice, reports, samples, models file-notings, legal or other opinions obtained by Public authorities, pertaining to the information sought above in English if possible.
