I write this to seek the following information relating to building rules in Municipal and Panchayat areas, and matters connected thereto, under the RTI Act, 2005.
1. Please clarify if panchayats fall under the definition of ‘notified urban area’ for the purposes of Assam Notified Urban Areas (Other Than Guwahati) Building Rules, 2014.
2. Please furnish information whether the rules as per Assam Notified Urban Areas (Other Than Guwahati) Building Rules, 2014 are applicable in panchayat areas.
3. Please clarify whether the Government of Assam has notified separate building rules/byelaws for municipal and panchayat areas, if any. If yes, the reference of the appropriate notification may please be provided.
4. Please furnish information as to whether the Development Authorities under Directorate of Town and Country Planning (under Urban Development Department) are empowered to frame rules/bye-laws for residential building construction in panchayat areas (which fall under Rural Development Department).
5. Please clarify whether the panchayats (other than Guwahati) are empowered to frame separate rules/bye-laws for construction of residential buildings, and/or their alteration, modification, etc.
6. Please furnish information whether the Development Authorities (other than Guwahati) are empowered to issue permits for construction of residential buildings, and/or their alteration, modification, etc in Panchayat Areas. If yes, reference to vesting of such power may please be provided.
7. Please furnish information regarding all the powers and functions of Development Authorities (other than Guwahati) in relation to Panchayat areas under their jurisdiction.
8. Please furnish information as to whether Development Authorities (constituted as per ATCP Act) have a role in issuing residential building construction/modification/alteration permits in panchayat areas which fall under their respective Master Plan Areas. Information relating to such role/powers may please be provided.
9. Please clarify as to whether, with regards to permits for residential building construction/modification/alteration, there is any distinction made between panchayats under Master Plan Area and those outside Master Plan Area. The details of such distinction, if any, may please be provided.
