Dear sir/madam,
Section 7 clause 3 of the Transgender Persons(Protection of Right) Rules, 2020 as notified in the Gazette of India says-
"The certificate of identity issued under sub-rule (1) shall entitle the applicant to record or change the gender, as well as photograph and name, if so necessitated of transgender person in all such official documents provided in Annexure – 1, in accordance with the gender specified in the said certificate of identity as male or female, as the case may be."
Annexure 1 says - "Any education certificate issued by a school, board, college, university or any such academic institution" as a document that can be changed under said clause. Thus, under the rules of the act, transgender people are entitled to record the change of gender, photograph, and name on CBSE documents.
Also, Section 3 Clause 3 says-
"Transgender persons who have officially recorded their change in gender, whether as male, female or transgender, prior to the coming into force of the Act shall not be required to submit an application for certificate of identity under these rules: Provided that such persons shall enjoy all rights and entitlements conferred on transgender persons under the Act."
1. Kindly specify the procedure for document change for transgender people bearing a Certificate of Identity under the Transgender Persons(Protection of Right) Rules, 2020.
2. Kindly specify the procedure transgender people who have changed their recorded their change in gender prior to the enforcement of the Act (as under Section 3.3) need to follow in order to change the gender, photograph, and name on the CBSE Class 10 & 12 marksheets, certificates, and other documents.
3. Kindly specify if there is a form or portal to do the same and where to get the form.
4. If there isn't a form, kindly specify the procedure to be followed, and whether CBSE plans on making a form or online portal to make this procedure more convenient.
