In the above reference, the PIO has denied providing the information stating that " The Information Sought is in Clarification/ Question answer form and does not come under the definition of 2(f) of RTI Act.

- The PIO has erred in denying the information on the grounds that it was sought in the form of a query/clarification. As per Section 2 (f) of the RTI Act, "information" includes any material in any form. The PIO has a statutory obligation to provide information if it is held by the public authority "irrespective of whether the same is sought in the form of a query." The PIO's decision violates the provisions of the RTI Act which mandates that citizens have a right to access information held by public authorities.

Given the above, the Appellate Authority is requested to Direct the PIO to provide the information sought. Take necessary action to ensure that the PIO is aware of and complies with the provisions of the RTI Act in the future. Instruct to the Concerned Central Public Information Officer to furnish the Information under The Provisions of RTI Act 2005
