As per the Right to Education Act(RTE), 2009, a school -

Section 12.(1) (b) Specified in sub-clause (ii) of clause (n) of section 2 shall provide free and compulsory elementary education to such proportion of children admitted therein as its annual recurring aid or grants so received bears to its annual recurring expenses, subject to a minimum of twenty-five per cent;

Section 12.(1) (c) Specified in sub-clauses (iii) and (iv) of clause (n) of section 2 shall admit in class I, to the extent of at least twenty-five percent of the strength of that class, children belonging to weaker section and disadvantaged group in the neighbourhood and provide free and compulsory elementary education till its completion: Provided further that where a school specified in clause (n) of section 2 imparts pre-school education, the provisions of clauses (a) to (c) shall apply for admission to such pre-school education."

According to the RTE Act and state RTE rule, local authorities are required to conduct mapping of schools to habitations according to the neighbourhood limits as notified by the state, before the commencement of the admission cycle every year.

1. Provide district wise list of unaided private schools, mandated to provide admission under RTE Section 12, and the areas or habitations (ex: Wards/Mohallas/Villages/Gram Panchayats/ or any other area) they are mapped under neighbourhood criteria for admissions.

2. Mention the neighbourhood limits set and procedure followed in mapping unaided private schools to habitations under Section 12 RTE Act, 2009.

3. Kindly provide me with the copy of the notification, circular, order, memo, direction, etc given to the district/block officials to map unaided private schools with habitations under set neighbourhood limits.

4. Mention the process followed along with the years in which the habitation mapping of schools has been done in the state, since the state has started the implementation of admission in private schools under section 12, RTE through notified state RTE Rules.

Provide hard copies, electronic copies where available in a CD/DVD, of relevant records, documents, memos, emails, opinions, advice, reports, samples, models file-notings, legal or other opinions obtained by Public authorities, pertaining to the information sought above in English if possible.

The applicant requests the PIO, if possible, to NOT send this RTI below the State level or below the district level, unless it is absolutely necessary.
