As per the Right to Education Act(RTE), 2009, a school -

Section 12.(1) (b) Specified in sub-clause (ii) of clause (n) of section 2 shall provide free and compulsory elementary education to such proportion of children admitted therein as its annual recurring aid or grants so received bears to its annual recurring expenses, subject to a minimum of twenty-five per cent;

Section 12.(1) (c) Specified in sub-clauses (iii) and (iv) of clause (n) of section 2 shall admit in class I, to the extent of at least twenty-five percent of the strength of that class, children belonging to weaker section and disadvantaged group in the neighbourhood and provide free and compulsory elementary education till its completion: Provided further that where a school specified in clause (n) of section 2 imparts pre-school education, the provisions of clauses (a) to (c) shall apply for admission to such pre-school education."

1. Provide district-wise data on the information sought below along with copies of relevant documents, records, files, orders, circulars, etc for the last 5 years (2014-2015 to 2018-2019):

a. Total admissions in pre-primary classes under section 12(1)(c) RTE Act

b. Total amount claimed as reimbursements by private school for such pre-primary admissions under section 12(1)(c) RTE Act

c. Total amount approved by the state government against the claims made by the private schools for pre-primary admissions under section 12(1)(c)

d. Total amount disbursed by the state government as reimbursements to private school for such pre-primary admissions under section 12(1)(c) RTE Act

e. Total amount pending to be disbursed by the state government as reimbursements to private school for such pre-primary admissions under section 12(1)(c) RTE Act

f. Total amount claimed by the state government from the Central government for pre-primary admissions under section 12(1)(c) RTE Act

g. Funds provided by the Central government as its share or special allowance for disbursement by the state government as reimbursements to private school for such pre-primary admissions under section 12(1)(c) RTE Act

2. Provide the records, documents, emails, file-notings, Legal or other opinions, cabinet decisions, or information available in any format related to the sharing of funds by the center and reasons thereof provided in lieu of admissions in pre-primary classes under section 12(1)(c) RTE Act.

3. Provide copies of official documents wherein the state government has issued a letter to the Central Government asking to contribute its share for pre-primary admissions’ reimbursements, and the replies received for the same by the state government.

4. Mention the procedure followed for disbursing reimbursements under Section 12(1)(c) of the RTE Act. Provide district-wise copies of all relevant documents, funds allotments, records, transfers, etc related to the information sought under below for the last 5 years (2014-2015 to 2018-2019):

a. Total admissions made under section 12(1)(c) RTE Act against which the reimbursements are claimed by the private schools

b. Total amount claimed by the private schools for admissions under section 12(1)(c) RTE Act

c. Total amount approved by the state government against the claims made by the private schools for admissions under section 12(1)(c) RTE Act

d. Total amount disbursed by the state government as reimbursements to private school for such admissions under section 12(1)(c) RTE Act

e. Total amount pending to be disbursed by the state government as reimbursements to private school for such admissions under section 12(1)(c) RTE Act

f. Total amount claimed by the state government from the Central government for admissions under section 12(1)(c) RTE Act

g. Funds provided by the Central government as its share or as a special allowance for disbursement by the state government for such admissions under section 12(1)(c) RTE Act

Provide hard copies, electronic copies where available in a CD/DVD, of relevant records, documents, memos, emails, opinions, advice, reports, samples, models file-notings, legal or other opinions obtained by Public authorities, pertaining to the information sought above in English if possible.
