As per the Procedure for obtaining information from CMTI under Right to Information Act (RTI): (Clause 4 (1) (b) (xv), Rs. 2/page will be paid for the complete details of the information provided.
7. Brief facts of the case leading to appeal: The PIO has not furnished any reply to the RTI application even though he has received the RTI as confirmed by the Postal Deptt and Postal receipt.
8. Reasons/grounds for this appeal:
As per Section-19(1) of the RTI Act, “Any person who, does not receive a decision within the time specified in sub-section (1) or clause (a) of sub-section (3) of section 7, or is aggrieved by a decision of the Central Public Information Officer or State Public Information Officer, as the case may be, may within thirty days from the expiry of such period or from the receipt of such a decision prefer an appeal to such officer who is senior in rank to the Central Public Information Officer or State Public Information Officer as the case may be, in each public authority” As I am not satisfied by the reply of the PIO I would like to invoke the above mentioned clause to exercise my right for an appeal before the CIC As per section 7(8) of RTI act 2005, “... the information which cannot be denied to the parliament or a state legislature, shall not be denied to any person”
9. Prayer/relief sought for:
I. Direct PIO to supply information as sought vide my RTI Application free of cost, within a period of 10 days from the decision of this Appeal.
II. The present appeal be disposed off by this Hon'ble Appellate Authority within 30 days of its receipt as provided under Section-19(6) of the Act;
