In RTI application reference DZD65NVA dated 24-11-2022(copy enclosed), it was specifically requested to mention the name of PIO and particulars of the appellate authority while replying to the RTI but neither of the above is meant by the PIO, which is a violation of the provisions of the RTI Act, 2005.
In so far as the reply is concerned, the Hon’ble CIC in it's several decisions has held that where a citizen has two or more options to obtain information/records, he has a right to choose the option as convenient to him.
Further, it is requested to please indicate the relevant provision of the RTI Act, 2005 which states that judicial records come under the exempted category.
Lastly, apart from copies of records, it was also requested to furnish details with regard to suo-motu action taken by Hon'ble Gurgaon Court in a very serious matter related to life & liberty of citizens/residents of Chintels Paradiso, which is not provided.
The, appellate authority, is requested to kindly direct the CPIO to furnish information being sensitive in nature.
While supplying information/records, due care must be taken to protect personal details of the petitioners/complainants.
