Most CPIOs deny information citing section 8 (1) (h) without showing as to how it will affect proceedings, if any.

Provide rules in this regard and whether CPIOs can apply 8 (1) (h) without without showing as to how disclosing information will affect proceedings, if any.

As per rules, information which is not related to disciplinary proceedings (but only action taken on requests) is not exempt under 8 (1) (h). Any circular issued by CIC in this regard may be shared. Also share judgements/orders.

Information provided after conclusion of disciplinary proceedings is of no value since harm is already done. Action taken by CIC in this regard may be intimated.

Information is crucial for submitting reply to allegations but still not provided by CPIOs. Action taken by CIC in this regard may be intimated.

Provide copy of circular issued by CIC/DOPT if any which states that information which is not related to disciplinary files (but only personal files) and which is crucial for submitting defence is to be shared.

It is also seen that files are tampered with/notes changed by the time disciplinary proceedings conclude. Action taken by CIC in this regard may be intimated.

Particulars of custodian of information till such time disciplinary proceedings are going on should be made available to delinquent official on conclusion of inquiry. Action taken by CIC in this regard may be intimated.
