A woman Consultant working with the Ministry of Health and Family Welfare (Delhi) is due to deliver her baby in July 2019. She has been denied Maternity Leave on the grounds that she is a contractual worker employed by the said agency. According to the circular issued by The Additional Chief Secretary to Government of Haryana (No.11/8/2014-3FR/11887; Memorandum No. 11/126/2007) - where State Health Mission is also implemented - dated 4th August, 2014, the maternity leave of the female contractual employees involved in all projects run by government organizations/agencies is also extended from 3 to 6 months.
The petitioner wishes to enquire about the following -
1. The reason(s) behind the denial of the maternity leave to the employee despite its documented provision in the Ministry of Health and Family Welfare.
2. The documentary proof with reasons to justify the denial of maternity leave to the employee.
